Introduction

This Privacy Policy will apply as of May 2018.

Aperto is aware of the importance of protecting your personal data and is committed to ensuring that it is processed responsibly and in compliance with the applicable data protection laws in all countries in which Aperto does business.

This data protection statement describes Aperto's general data protection procedures that apply to the processing, including the collection, use and disclosure of personal data of users and other persons at our customers, business partners, suppliers and other companies with whom Aperto has or is considering a business relationship.

This Privacy Policy is supplemented by the Privacy Policy - Online Services - which contains further information about the collection or use of personal data on our website, including the Applicant Portal.

Why and how is your personal data collected and used?

We may collect your personal data for various purposes, such as responding to your requests for information, ordering or support.

When you contact us (online or offline) in connection with a request for information, ordering a product or service, providing support or participating in a forum, we collect the information we need to fulfill your request, provide you with access to the appropriate product or service, provide support and contact you. For example, your name and contact information, details of your request, your agreement with us and the fulfillment, provision and billing of your order are collected, and information from customer satisfaction surveys can be included. This information is stored for administrative purposes, to protect our rights and in connection with our relationship with you.

Establishing contacts with employees of our customers, potential customers, partners and suppliers

As part of our relationship with customers, prospective customers, partners and suppliers, they also provide us with business-related contact information (e.g. name, business contact information, position or title of their employees, contractors, consultants and authorized users) for the purposes of contract management, order fulfillment, the provision of products and services, the provision of support, billing and management of the services or the business relationship.

Visitor information

We register people visiting our site (name, identification and business-related contact information).

Marketing

Most of the information we collect about you comes from our direct interactions with you. When you register for an event, we may collect information (online or offline) regarding the event organization, but also during an event, such as participation in individual modules and survey results.

Events may be recorded and group photos taken. We reserve the right to use photos for advertising purposes. If you provide us with your business-related contact information (e.g. in the form of a business card), we may use it to communicate with you.

Some of our offers or events may be offered under a common (cobranded) brand or financed jointly by IBM and third parties such as business partners and solution providers who use, resell or complement IBM products or services. Offers and events under a common brand clearly indicate that such a partnership exists. If you register for these offers or events, you should be aware that your personal data may also be collected and shared by these third parties. We therefore recommend that you familiarize yourself with the respective data protection declarations in order to see how your data will be used there.

If you want to send this page by e-mail to a friend or colleague, you must enter their name and e-mail address. In this case, we will automatically send a one-time e-mail to forward the page you have specified, but will not use this personal data for other purposes.

Occasionally, we may also collect information from other sources (e.g. from other providers) that indirectly relates to you. In this case, we request the respective providers to confirm that the information has been collected lawfully and that Aperto is entitled to receive and use this information.

The information collected by Aperto, either directly or indirectly, may be combined to improve overall accuracy and completeness and to optimally adapt our interaction with you to your specific needs.

If we indicate that we use your personal information in connection with an inquiry, order, transaction or agreement (or preparation thereof) or to provide you with services that you have requested (e.g. a website), we do so because it is necessary to fulfill an agreement with you.

If we indicate that we use your personal information in connection with marketing, improving or developing our products or services, for security reasons or due to legal provisions that are not in connection with your agreement or requirement, we do so based on our legitimate interest, the legitimate interest of a third party or with your consent. The collection and use of personal data subject to EU data protection law may affect your rights.

Transmission of personal data

If appropriate or based on your consent, Aperto may also pass on your personal data to selected partners who support us in providing you or the company you work for with products or services or in meeting your requirements. When selecting our subcontractors and partners, their data processing processes are taken into account.

To facilitate this task, your data may be exchanged with third parties involved in order processing, e.g. IBM Business Partners, financial institutions, shipping companies, postal services or public authorities (e.g. customs authorities).

If our parent company IBM decides to sell, buy, merge or otherwise reorganize companies in certain countries, such a transaction may include disclosure of personal information to potential or actual purchasers or receipt of such information from sellers. It is common practice at IBM to require appropriate protection of personal data in such transactions.

Please note that in certain situations it is possible that personal data must be disclosed to authorities due to a court or official order or to comply with legal process. We may also disclose your personal data to protect the rights and property of Aperto, IBM and IBM Business Partners, suppliers, customers or third parties if there are reasonable grounds to believe that such rights or property have been or may be affected.

International data collection

Aperto's international activities within the IBM Group may involve the transfer of personal data between various IBM Group companies and to third parties based in the countries in which we do business.

If necessary, IBM uses the standard contractual clauses approved by the EU Commission or comparable contractual clauses in other legal systems. This includes data transfers to suppliers or other third parties.

Security and quality of information

It is our concern to protect your personal data and to guarantee its correctness. Aperto has implemented appropriate physical, administrative and technical security measures to protect your personal data from unauthorised access, use and disclosure. For example, we require our suppliers and partners to protect this data from unauthorized access, use and disclosure.

Storage period

Personal data will not be kept longer than necessary to fulfil the purposes for which they are processed, including the fulfilment of legal or official obligations (e.g. examination, accounting and legal retention periods), the settlement of disputes and the establishment, exercise or defence of legal claims in the countries in which we do business.

Because circumstances may vary depending on context and services, the information contained in a specific agreement may include more detailed information on the applicable retention periods.

Offsprings

Unless otherwise stated, our websites, products and services are not intended for children under the age of 16.

Your rights

You can request information about your personal data, its update or correction. You may have additional rights in relation to data processing in accordance with the law applicable to you. If, for example, the processing of your personal data is subject to the regulations of the DSGVO and your personal data is processed on the basis of legitimate interest, you are entitled to object to the processing for reasons arising from your particular situation. As part of the DSGVO, you also have the right to request the deletion, restriction of processing and transfer of your personal data.

Right of appeal

If you believe that the processing of your personal data violates the applicable data protection laws, you can file a complaint directly with Aperto at daten-schutz@aperto.com. At the responsible supervisory authority. Names and contact information of the competent supervisory authorities in the European Union can be found at http //ec.europa.eu/justice/data-protection/article-29/structure/data-protection-authorities/index_en.htm.

Introduction

This statement informs you about how Aperto handles personal data in its online services, i.e. on its website and in the Applicant Portal, which information about users is collected and evaluated by the website and how this information is used, passed on or otherwise processed offline.

This Privacy Policy - Online Services supplements the General Privacy Policy.

However, this Aperto Privacy Policy - Online Services does not apply if Aperto processes information exclusively on behalf of customers, e.g. as a web hosting service provider. In this case, Aperto would supplement an agreement with additional information relating to a particular interaction with you, such as an order document or a specific privacy policy, if you have ordered or use a service.

Why and how is your personal data collected and used on our website?

When you open and use our website or use our online applicant portal, information is recorded that is necessary to access and operate the website and to comply with technical and legal requirements in connection with the operation of our website, such as passwords, IP address and web browser settings. Information about your activities during your visit to the respective website is also collected in order to obtain statistical data in order to improve and further develop our websites, products and services.

We collect personal data from your visits to our websites in order to collect statistical data about the use and functionality of our website, to optimally adapt our interaction with you to the respective needs and to improve our products and services. We use cookies for this purpose.

What are cookies and why are they used?

A cookie is a data element that sends a website to your web browser to be stored on your system as an identifier that identifies your system. While cookies are often used only to measure the usage (such as number of visitors and duration of a visit) and effectiveness (such as topics of most interest to the visitor) of a website and to facilitate navigation or use, and as such are not linked to personal data, they are also occasionally used to personalize the website experience of a known visitor by associating profile information or user preferences. Over time, this information provides valuable insights that help improve the user experience on a website.

Cookies are usually divided into session cookies and permanent cookies. Session cookies allow you to efficiently navigate through the website and log your journey through each page so that you are not prompted to enter information that you have already entered during the same visit to the website or that is needed to complete a transaction. Session cookies are stored in temporary memory and deleted as soon as the Web browser is closed. Permanent cookies, on the other hand, store user settings for the current visit and for future visits to the website. They are saved on your hard disk and are still valid when you restart the web browser.

Privacy policy regarding the use of cookies

When you visit our website or Applicant Portal, you have the option of setting preferences for coo-kies using the options provided to you by your web browser.

In most cases, you have the option of setting your web browser to notify you when you receive a cookie so that you can decide whether or not to accept it. You can also deactivate the receipt of cookies via your web browser. You can delete cookies that are already on your device via the settings of your web browser. If you block, disable or otherwise decline our cookies, certain websites may not display correctly.

Google Analytics and Google Remarketing

This website uses Google Analytics, a web analysis service provided by Google Inc. "("Google") and Google Remarketing, a service used by Google to serve interest-based ads. Offered by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google Analytics uses cookies. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. However, if IP anonymisation is activated on this website, Google will previously reduce the visitor's IP address within Member States of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.

On behalf of Aperto, Google will use this information to evaluate the use of the website by the visitors, to compile reports on the website activities and to provide the website operator with further services associated with the use of the website and the Internet. The statistical processing of the data is made available to Aperto via protected access. Google may also transfer this information to third parties if this is required by law or if third parties process this data on behalf of Google. The IP address transmitted by visitors' browsers in the context of Google Analytics is not merged with other Google data. You can prevent Google Analytics from collecting your data by deactivating the collection of your data on future visits by Google Analytics on the following website https //support.google.com/analytics/answer/6004245?hl=en.

Aperto has a legitimate interest (Art. 6 para. 1 lit. f DSGVO ) in analysing user behaviour in order to optimise both its website and its advertising.

Piwik / Matomo web statistics

This website also uses the open source software Piwik/Matomo for statistical evaluation of visitor access.

Piwik/Matomo uses cookies which are stored on the visitor's computer and which enable an analysis of the use of the website by the visitor. The information generated by the cookie about the use of this website is transmitted to a server of Aperto GmbH and stored in Germany. IP addresses are stored in Piwik/Matomo without the last tuple. In this way it is known from which network a request came, but not from which computer. The collected data will in no case be connected with other or personal data. Data that is no longer used for the purpose of web analysis will be deleted immediately.

Aperto has a legitimate interest (Art. 6 para. 1 lit. f DSGVO ) in analysing user behaviour in order to optimise both its website and its advertising.
